WAIVER

Dana Point Tennis LLC dba DP Tennis Academy COMPREHENSIVE PARTICIPATION AGREEMENT ASSUMPTION OF RISK • RELEASE OF LIABILITY • INDEMNIFICATION • MEDICAL AUTHORIZATION • MEDIA RELEASE

1. Scope of Agreement
This Agreement is entered into by the undersigned participant and/or the parent or legal guardian of a minor participant ('Participant') in favor of Dana Point Tennis LLC dba DP Tennis Academy, including its owners, members, managers, officers, directors, employees, coaches, assistant coaches, independent contractors, volunteers, agents, representatives, successors and assigns ('Released Parties').

2. Covered Activities
This Agreement applies to all current and future activities including private lessons, semi-private lessons, group lessons, junior and adult programs, high-performance training, summer and holiday camps, clinics, leagues, ladders, tournaments, challenge play, round robins, exhibitions, socials, fitness sessions, off-court conditioning, travel events, demonstrations, volunteer activities and any use of tennis courts, pickleball courts, club facilities, parking areas, sidewalks or adjacent premises.

3. Inherent Risks
Participant understands athletic activities involve inherent risks including slips, trips, falls, collisions, impact from racquets or balls, equipment failure, weather, uneven surfaces, dehydration, heat illness, allergic reactions, cardiac events, strains, sprains, fractures, concussion, paralysis and death.
These provisions are intended to apply broadly to activities at Nellie Gail Ranch Tennis & Pickleball Club or any other location where DP Tennis Academy conducts operations. Examples include camps, leagues, clinics, tournaments, private lessons, public events, demonstrations and incidental activities before, during and after participation.

4. Assumption of Risk
Participant knowingly and voluntarily assumes all known and unknown risks, whether foreseeable or unforeseeable, associated with participation.

5. Release of Liability
To the fullest extent permitted by California law, Participant releases the Released Parties from claims arising from ordinary negligence related to participation, except where prohibited by law.
These provisions are intended to apply broadly to activities at Nellie Gail Ranch Tennis & Pickleball Club or any other location where DP Tennis Academy conducts operations. Examples include camps, leagues, clinics, tournaments, private lessons, public events, demonstrations and incidental activities before, during and after participation.

6. Covenant Not to Sue
Participant agrees not to commence or maintain legal proceedings against the Released Parties for matters released herein.

7. Indemnification
Participant agrees to defend, indemnify and hold harmless the Released Parties from third-party claims, damages, judgments, attorney fees and costs arising from Participant's conduct.

8. Health Certification
Participant certifies they are physically capable of participation and accepts responsibility for consulting healthcare professionals when appropriate.

9. Emergency Medical Authorization
Participant authorizes emergency medical evaluation and treatment when deemed reasonably necessary and accepts financial responsibility for all related costs.

10. Facility & Equipment Inspection
Participant will inspect facilities and equipment before use and immediately report unsafe conditions. Participation will cease if conditions appear unsafe.

11. Participant Responsibilities
Participant agrees to follow staff instructions, comply with safety rules, use equipment appropriately, respect other participants, refrain from dangerous conduct and immediately disclose injuries or illness.

Examples include camps, leagues, clinics, tournaments, private lessons, public events, demonstrations and incidental activities before, during and after participation.

12. Communicable Diseases
Participant acknowledges the possibility of exposure to communicable diseases despite reasonable precautions and voluntarily assumes those risks.

13. Photography & Media
Participant grants permission for photographs, video and audio recordings to be used for promotional, educational and marketing purposes without compensation.

14. Minors
A parent or legal guardian signs individually and on behalf of the minor participant and acknowledges the responsibilities described in this Agreement.

15. California Civil Code §1542
Participant expressly waives the protections of California Civil Code §1542 to the fullest extent permitted by law.

16. Governing Law & Venue
California law governs this Agreement. Exclusive venue shall be Orange County, California unless otherwise required by law.

17. Severability
If any provision is found unenforceable, the remaining provisions remain effective.

18. Entire Agreement
This document represents the entire agreement relating to participation and supersedes prior understandings.

19. Electronic Signatures
Electronic signatures and click-through acceptance shall be treated as originals.

20. Acknowledgement
Participant acknowledges reading, understanding and voluntarily accepting this Agreement, recognizing that important legal rights, including the right to sue, are being waived.
